What is Medical Malpractice Insurance?

Medical Malpractice Insurance covers you for damages or claims expenses because of physical injury, death, mental injury and illness, mental anguish, disease, disability, sickness and shock of any patient.

You can choose the amount of cover that you need. It also includes professional indemnity and public liability to give you maximum protection under a claims made basis – see FAQs below.

What Does It Cover?

  • Professional Indemnity cover for any financial loss caused to third parties during the provision of your professional services.
  • Public/General and Product Liability cover for bodily injury and/or property damage caused by an accident in connection with your business.
  • Loss of documents (destruction, damage or loss) owned or entrusted to you.
  • Breach of professional confidentiality.
  • Libel and slander committed without malice in the conduct of your business.
  • Inquest costs in respect of unexpected deaths which may give rise to a claim.
  • Good Samaritan acts.

Do I Require Medical Malpractice Insurance?

No – But, given your exposure to risk from your patient services, cover is strongly recommended.

How Much Cover Do I Need?

The main consideration when choosing a liability limit is, what would be the likely cost to put something right?

We provide up to £5 million of Medical Malpractice cover, though you can choose a lower limit if you don’t need that much. Don’t pay for more than you need.

The cost of your insurance will depend on several factors, e.g. the size and type of your business and the risk of a claim.

The cost (or “premium”) is based on the predicted likelihood of a claim being made against you and the potential size of any claim.

There is a small excess (or deductible) amount.

However, you only have to pay this if a claim against you is successful, so you can discuss any worries or concerns you have about anything related to a potential claim without worrying that you will be charged for it.

A “claims made” policy will pay those claims that occur while the policy is active and in force. Any claims made while the policy is active will be fully covered, as long as they are reported in a timely manner.

The purpose of the insurance is to provide cover for mistakes made, it is not a general business insurance policy.

For example, it doesn’t cover loss or damage to equipment – this would be covered by Contents insurance. If you would like more information on what’s not included, read our list of exclusions below.

Medical Malpractice insurance will not make any payment for any claim or loss resulting from:

  • Circumstances and claims known before the start date of the policy.
  • Claims caused by any malpractice incident, accident, negligent act, error, omission, breach or loss occurring before the start date of the policy.
  • Dishonest and malicious acts.
  • The operation of blood or human tissue banks unless that is your usual business.
  • Medical research services, medical trials or drug testing.
  • Claims if you are under the influence of drugs and/or alcohol.
  • Sexual abuse or molestation.
  • Loss of medical records.
  • Claims between medical staff.
  • Liability that you assume under a contract or agreement.
  • Employment related practices liability.
  • Defence costs in relation to the defence of any regulatory or disciplinary proceedings unless specifically covered under the Policy.
