Medical malpractice insurance is needed by workers providing medical care or ancilliary services to patients, where there could be a risk of injury, illness, or death as a result of the services provided.

Our medical malpractice insurance has an adjustable limit, so you can choose the amount of cover that you need. It also includes professional indemnity and public liability to give you maximum protection for claims made against you.

What does medical malpractice insurance cover?

Our Medical Malpractice Insurance covers you for damages or claims expenses that you may be liable for because of physical injury, death, mental injury and illness, mental anguish, disease, disability, sickness and shock of any patient.

The policy includes:

  • Professional Indemnity cover in relation to any financial loss caused to third parties by your negligent act, error or omission during the provision of professional services.
  • Public/General and Product Liability cover in relation to any bodily injury and/or property damage caused by an accident in connection with your business.
  • Loss of documents (destruction, damage or loss) owned or are entrusted to you.
  • Breach of professional confidentiality during your business.
  • Libel and slander committed without malice in the conduct of your business.
  • Inquest costs in respect of unexpected deaths which may give rise to a claim.
  • Good Samaritan acts where you render assistance to a passerby not under your direct care.

How much does this insurance cost?

The cost (or "premium") is based on the predicted likelihood of a claim being made against you and the potential size of any claim.

What limit of liability should I choose?

The main thing to bear in mind when choosing a liability limit is - if something went wrong, what would be the likely cost to put it right?

We offer up to £5 million of Medical Malpractice cover, though you can choose a lower limit if you don't need that much, so you don't pay for more than you need.

Do I have to pay an excess?

There is a small excess (or deductible) amount. However, you only have to pay this if a claim against you is successful, so you can call us to discuss any worries or concerns you have about anything related to a potential claim without worrying that we are going to charge you for it. We are here to help.

What is a claims made policy?

A "claims made" policy will pay those claims that occur while the policy is active and in force. Any claims made while the policy is active will be fully covered, as long as they are reported in a timely manner. Tapoly's Medical Malpractice policy operates on a claims made basis.

What's not covered by Medical Malpracice insurance?

The purpose of the insurance is to provide cover for mistakes made, it is not a general business insurance policy. For example, it doesn't cover loss or damage to equipment - this would be covered by Contents insurance. Tapoly's Medical Malpractice insurance will not make any payment for any claim or loss resulting from:

  • Circumstances and claims known before the start date of the policy.
  • Claims caused by any malpractice incident, accident, negligent act, error, omission, breach or loss occurring before the start date of the policy.
  • Dishonest and malicious acts.
  • The operation of blood or human tissue banks unless that is your usual business.
  • Medical research services, medical trials or drug testing.
  • Claims if you are under the influence of drugs and/or alcohol.
  • Sexual abuse or molestation.
  • Loss of medical records.
  • Claims between medical staff.
  • Liability that you assume under a contract or agreement.
  • Employment related practices liability.
  • Defence costs in relation to the defence of any regulatory or disciplinary proceedings unless specifically covered under the Policy.
